A Torpedo is Aimed at Kentucky Speedway
The anti-trust lawsuit filed by the owners of Kentucky Speedway may be on the verge of suffering a fatal blow to their chances of winning its case against NASCAR and the ISC.
The Automobile Competition Committee for the United States (ACCUS) has asked to file a legal brief in support of NASCAR and ISC because the case involves how sanctioning bodies determine the tracks that hold theri respective races.
Members of the ACCUS is comprised of every major sanctioning body in American motorsports including, NASCAR, the Indy Racing League, the International Motor Sports Association, the National Hot Rod Association, Champ Car, the United States Auto Club, the Sports Car Club of America and the France-family controlled Grand American Road Racing Association.
“Kentucky Speedway asks the Court to substitute a jury’s judgment for the considered judgment of the sanctioning body responsible to the sport and its fans…,” the association writes in its brief. “If tracks could overturn sanctioning decisions merely by convincing a local jury that they ‘deserved’ to host a race, courts would be endlessly embroiled in settling such disputes.”
In the famous words of George Burns, “Say good night Gracie,” with all that horsepower aligning with NASCAR Kentucky’s party is over before all the invitations are sent out.
But we surmised that two years ago based on the experiance gained by one of the lawyers from the TMS lawsuit.
In short, Samuel Cherry, who represented Francis Ferko and Texas Motor Speedway, gave Kentucky’s lawsuit less of a chance than a frosted donut in the hands of Homer Simpson.
