Contradictions and Irony

That’s what NASCAR is calling Kentucky Speedway’s anti-trust lawsuit against the sactioning body.

NASCAR wants a federal judge to dismiss a $400 million lawsuit filed by Kentucky Speedway, calling the action “a study in contradictions and irony.”

The lawsuit seeks to force NASCAR to award the track a Nextel Cup race.

In a separate filing, another defendant, International Speedway Corp., asked U.S. District Judge William Bertelsman to dismiss the case, move it to a federal court in Florida and to schedule a hearing in which oral arguments can be presented.

The filings were made Monday in Covington, Ky.

Some of you may recall NASCAR settled out of court a similar lawsuit filed by Francis Ferko and Texas Motor Speedway. That settlement was pushed by NASCAR

  1. As much as I hate some of the decisions NASCAR has made as far as tracks go (Going to California twice in one season) I’m glad they are standing strong on this one. NASCAR can’t go around giving race dates away. They are going to have to cut back on the tracks they go to now, just to fit in different regions. I happen to like Kentucky, but there are better tracks and areas to go to.

  2. I feel the same, the schedule is full now and the only way to accomodate more NEXTEL Cup dates is to lengthen the season or drop the second events at some tracks.

    Having said that, Cali isn’t one that should be dropped. The “land of fruits and nuts” has the second largest economy in the world. That’s not something any business would ignore.

  3. I understand the economy of California but this is NASCAR and eventually racing is going to have to take precident over the market. That being said, if they built a better track over there, then 2 West Coast trips wouldn’t be a problem.

  4. Depends what you consider “two West Coast trips” Sonoma has 2 events and so does Las Vegas. Add in two trips to Phoenix and that makes 8 west of the Rockies.

    You may feel racing should take precedence over marketing but that hasn’t been the case in over 25 years.

I assure you it will be a quality product and you have no right to dictate whether I can appear in your fine series. You are depriving me of my constitutional right to be heard and possibly make millions of dollars. My financail interests will be severely impacted by your unreasonble denial.

    The Kentucky Speedway suite is a bigger crock than the load I just spewed above.

  6. As much as I’d love to sign you up George, my shyster lawyer, (the one with a golden plateau of superior wisdom and 60% retainer fee) advises against adding any authors at present.

    But if you’re willing to wait til, oh say… about the time Beelzebub opens a Ben & Jerry’s franchise or Kentucky Speedway hands out it’s first NEXTEL Cup trophy, which ever comes first, I’ll consider the offer.
