Kentucky Speedway Suit Dismissed
According to the AP Federal Judge William O. Bertelsman has tossed Kentucky Speedway’s anti-trust case into the ashcan of history.
WARNING, snarky comment to follow: It took this judge 18 months to figure this out? I want part of his paycheck. And a judges robe. George needs a fitting for a new robe also.
At this writing, 30 minutes after this hit the wires, there is no word why Judge Bertelsman tossed the suit other than the obvious, NASCAR or the ISC didn’t violate anti-trust laws. When, and if the meat of his ruling gets published I’ll update this post.
Hmmm… Sparta Kentucky? Why do I recall 6th century Sparta?
Oh wait, I know. The Spartans, excellent soldiers to the core, defeated the local population of helots and in turn forced them to provide part of the food they grew so the Spartans didn’t have to work as hard.
Fifteen centuries later certain residents of Sparta Kentucky, namely Kentucky Speedway owners, attempted something similar. Rather than working for, and waiting in line for a NASCAR Cup date, they attempted to use an “army of lawyers” to obtain a Cup date via judicial fiat.
And failed. Now get in line. The back of the line.

The sad part of the entire mess is there should be a Cup race at Kentucky as well as Nashville and Milwaukee. But short of yanking dates from other facilities, not gonna happen. Especially Kentucky. Same old story. Lawyers booze and fans lose.
And Iowa.
The auto racing industry as far as NASCAR goes has been over promoted in a sense. It’s enormous growth in the last decade led to many jumping on the bandwagon with the pie in the sky idea if they had a track a Cup date would come.
Its’ just not possible when the season is ten months long

I hadn’t gotten to it yet, but to be honest with you I feel that has been a dead issue for a long time - it just took the “official” word on it to make it official. Frankly, I think everyone is just tired of hearing about it and that is why it is on the back pages in AP form.
Now should there be a race there, ya I think so, but as the Dude said, “where is the date going to come from?”
I also think there should be a race in Canada for that matter - but that is a whole other can of worms that I may touch on yet again at my site if the owner of Cayuga ever gets back to me for an interview.

As one of my links shows the lawyer that handled the Texas suit begged off this suit and firmly believed it had no merit 19 months ago.
For me that was enough, it was DEAD.
Sure anyone who sinks a couple hundred mil in a track “deserves” a date, but to think you can get one when the sched consists of 10 months and 38 races dates is pure fantasy.
