NASCAR: A New Definition of “Inconclusive”
Inconclusive; Adjective: Not conclusive; not putting an end to doubt or question; “an inconclusive reply”; “inconclusive evidence”; “the inconclusive committee vote” leading to no final results or outcome; “an inconclusive experiment”
NASCAR running counter to earlier pronouncements that video taped evidence in the case against Robby “Padding Toss” Gordon (formerly known as “Helmet Toss”) was “inconclusive,” has defined their position further:
Inconclusive (NASCAR Version); Adjective: $15,000 fine and “Padding Toss” penalized 50 driver championship points and 50 car owner championship points. “Helmet Toss” placed on probation by NASCAR until Dec. 31; Crew chief, Greg Erwin, fined $10,000, placed on probation until December 31.
Somehow, somewhere HWSBO and Jim “The Marionette” Hunter, plus a cast of thousands (with Ouija boards in hand) in the deepest bowels of corporate HQ’s, have concluded the “inconclusive.” How that was accomplished isn’t a matter of public record, remember “officials” couldn’t determine the culprit via the tape. So it is, and probably will remain a mystery.
What is on record is the doubling of the points penalty issued as compared to the preceding entry on his rap sheet. Tossing his helmet was done at a cost of 25 owners and drivers points.

Actually 4e3, upon further reflection I don’t think I went far enough.
He should have been disqualified from the Atlanta event entirely. Zero points and zero money.
At least not scored on the lead lap.
Maybe no guaranteed start while on probation? That would wake up the T35 in owner points better than money. If they want to break the rules, make them race their way in.
I think they should lower that number (T35 get guaranteed start), anyway. But that’s for another post.
I’m all about fining where there is a wrong doing… maybe however, a little CONSISTENCY could be in order however????
What consistency are you looking for? Can you point me to another case of a driver being fined or suspended for purposefully causing a yellow flag that effected the outcome of a race?
I noted your comment over at That’s Racin’ and don’t agree with your example of comparing Gordon’s current problem and a spin and penalty as it relates to Dale Jr.
You use that as a way to claim inconsistency on NASCAR’s part.
It’s also and apples and oranges argument. IF your looking for consistency and a “standard” that you called for you have it
And Gordon received it based on no other driver i the modern era being penalized for this type of infraction.
If someone in the future commits the same offense and receives a different “sentence” I would agree.
