NASCAR Lawsuit: This is an Issue Now? Why?
Far be it from me to pre-judge any legal proceeding, even one that hasn’t reached a court as yet, but this story stinks to High Heaven.
So, in the best traditions of a politicians “Flip-Flop” I’ll quickly reverse myself and say - BULLSHIT!
The issue stems from events that started in 2001 - (and it’s just coming to light now, or in the intervening 6 years!? - ed).
The offenses continued until NASCAR fired him from his job in the Cup series on Nov. 14, 2007 - (Replay ed’s comment above - ed).
A complaint is filed and alleges racial discrimination, a hostile work environment and wrongful termination - (Yeah ok, a shyster got a hold of him, this is standard fare -ed).
In talking to the Associated Press the complainant says, “I’m looking for something. Even if NASCAR was to offer me my job back, I would do that,” he said. “If they wasn’t going to offer me my job back, I’m shooting for a lawsuit.” - (“If they wasn’t” fits every demeaning NASCAR stereotype on the books. What did he inspect for NASCAR Ward Burton’s version of English? But I digress -ed).
The complainant (Dean Duckett) continues stating his problems started last Nov. 10 when he got into a heated argument with another official the night before the Phoenix race.
“I said to him, ‘I ought to cut you.’ I don’t carry no blades or nothing like that,” Duckett said. “It basically came out in the heat of the moment. We got into each others faces but nothing happened. My roommate pulled me away and said, ‘C’mon guys leave it alone,’ and we left.” - (But, but…, if this stems from an incident this past Nov, when he threatened to use an easily concealed weapon, as opposed to a Gov. Palin-like Moose killer, AND gets fired for it, why the charges going back to 2001? - ed)
“They took my life away,” Duckett said. “I loved my job. I put everything into my job. I feel they took away from my family.” - (Well, his command of English has improved, the past tense of love is “loved,” He has that going for him - ed).
Final thought: What the hell shyster took this guy on to represent, was it former VP candidate-ambulance chaser-”I channel dead kids”-400 buck haircut John Edwards?
Whoever it was is a fool, this won’t get past the complaint filed with the Equal Employment Opportunity Commission.
There, I said it. I prejudged this complaint without knowing all the facts. So sue me. (I hope Edwards isn’t listening!)
UPDATE: Damn, I should’ve seen this connection. This Duckett character was named in the Mauricia Grant lawsuit. Funny how that “merry-go-round” works.
Her lawsuit claimed Duckett was reprimanded and ultimately fired last November for using “aggressive language toward a white co-worker.”
Gee, would that be threatening someone with a knife whether imaginary on not?

Ya know, I can only approach these things with logic. I would expect that, if someone’s work environment was hostile throughout its tenure, I would expect that tenure to be pretty short. If your work environment is hostile, and you do or say nothing about it at all for well over six years, I’m having a really hard time believing it was so intolerably hostile. And then when you follow up that charge of hostile work environment with comments about just how much you loved your job and want it back, I’m having a really hard time believing it was really all that hostile. Hey, but that’s just me. Who wants to bet on whether Ms. Grant’s attorney/firm will end up representing Duckett, too? If hers is worth $225 million, his has got to be at least twice that, maybe three times. After all, he “suffered” so much longer.
I believe Ms. Grant’s complaint about Duckett was he dropped his drawers (droors? How do you say that in Redneck?) and flashed her…
I don’t get it.
I bet NASCAR settles with the Lady. Will they give Duckett his job back? They better not.
What a figgin mess.
